l have a 40 acre Emu ranch and would like to leave my daughter, my son and my four grandchildren an inheritance. The problem is that my son has remarried and his wife has custody of his children. My daughter is living on 2 acres that l deeded to her and her ex-husband. She has remarried to a wonderful man that has no interest in any claim to what was hers before the marriage. My question is how can l set up my estate so that my son is ex-wife and his current wife and my daughters ex cannot have a legal claim to what l wish to go to my son, daughter, and grandchildren? Any suggestions would be greatly appreciated.

Sounds like you need a trust.

You can set it up as a living trust, or as a trust in your will (testamentary).

What you want to do is put wording in there so that your children do not inherit ownership of the ranch..they can only use it and/or draw income from it. At their death, it will pass to your grandchildren.

the complexity of your wishes are far too important to leave it in the hands of armatures (meaning me).

The most economical way to leave an estate to anyone is with a trust, not a will. Contact a good experienced trust attorney who will create a ''revokable trust'' (meaning changeable to ur wishes) that will immediately become effective upon ur death. There is no probate or estate taxes, cannot easily be challenged like a will can be, & it is immediate instead of years in the court system. It costs more to set up a trust so have ur beneficiaries pay for those fees rather than paying estate fees when they have other things to worry about. You do not have to be rich for a trust. u just have to be smart. Why do attorneys prefer to sell wills??? Because they get paid up front plus at the back end in carrying out ur wishes in the probate system.
